Dallas Copyright Lawyers

Whether you are a painter, filmmaker, writer, musician or any other type of creative artist, you have invested time and energy into your artistic creation. While federal copyright law provides a measure of protection at the time the creative work is made, registering your creative work with the U.S. Copyright Office will provide you with maximum legal protection.

At Gagnon, Peacock & Vereeke, P.C., we help artists protect and maximize the value of their artistic work. In a world that consumes art constantly, our experienced Dallas copyright attorneys understand how important it is that artists’ work is protected and valued for the beauty and conversation that it brings to the world. If you are interested in further protecting your creative works, or you suspect that someone has violated your creative rights as an artist, we want to help you. To discuss your case in a free consultation, call us at (214) 824-1414 (toll free at 888-312-1750) or send us an e-mail.

Do I Need A Lawyer?

In order to ensure that your work is protected, you may want to consult with an attorney. An attorney can be instrumental whether you need to apply for copyright or if you think your copyright has been infringed on. A lawyer can help ensure that you complete your application correctly and file it properly. This can expedite the copyright process. When it comes to protecting a copyright that you think may have been infringed upon, a lawyer can go over copyright laws with you and help determine if your work has been stolen. If it has a lawyer can help you recover compensation for the stolen work and put an end to the infringement. Alternatively, if you are accused of violating copyright, a lawyer can defend you and help you show that your use was legal.

When Should I Hire a Lawyer?

It is never too soon to discuss your options and rights with a lawyer if you believe that your creative work needs more protection. Often people don’t contact an attorney unless they are experiencing trouble related to copyright infringement. However, if you are curious about your rights, you do not need to wait until you are experiencing trouble to learn about them. Speaking with a lawyer will give you an idea of what protections are already extended to you and what other protections you can obtain over your work.’

The Copyright Act

The Copyright Act grants protection to a wide range of material, which can include but is not limited to the following:

  • Literary works
  • Musical work
  • Dramatic work
  • Pantomime and choreographic work
  • Pictorial, graphic and sculptural work
  • Motion pictures and other audiovisual work
  • Sound recordings
  • Computer software
  • Architectural work

Additionally, the Copyright Act grants to authors the exclusive right to:

  • Reproduce the copyrighted work
  • Prepare derivative work based on the copyrighted work
  • Distribute copies of the copyrighted work
  • Perform the copyrighted work publicly
  • Display the copyrighted work publicly
  • Sound recording* (perform publicly by means of digital audio transmission)

From poetry to software, our Texas law firm can help you protect your work.

Additional Benefits After Registration

While a copyright owner need not register a work with the Copyright Office, certain statutory benefits and protections are unavailable to unregistered copyright owners during a lawsuit. An inherent ownership belongs to the person or group who is responsible for original work, but if legal action is required at some point, registered work is protected more comprehensively under the law.

For example, a copyright owner who prevails in court against an infringer but failed to register the work may be unable to obtain a reimbursement of attorneys fees from the infringer, or may be unable to obtain treble damages. For maximum legal protection and additional legal benefits, artists should register their work.

We also represent parties in copyright infringement litigation.
